§ 26-121. Liability.

  • (a)

    Neither the approval of a plan under the provisions of this article nor the compliance with provisions of this article shall relieve any person from the responsibility for damage to any person or property otherwise imposed by law, nor impose any liability upon the issuing authority or district for damage to any person or property.

    (b)

    The fact that a land disturbing activity for which a permit has been issued results in injury to the property of another shall neither constitute proof of, nor create a presumption of a violation of the standards provided for in this article or the terms of the permit.
