§ 42-101. Findings.

  • (a)

    The location, design and method of operation of municipal solid waste handling facilities can adversely affect the health, safety and well-being of the public and can degrade the quality of the environment.

    (b)

    Pursuant to O.C.G.A. § 12-8-31.1, the board of commissioners is authorized to adopt a solid waste management plan which enumerates the solid waste handling facilities which are and may be located in the county as to size and type and which identifies those sites which are not suitable for solid waste handling facilities based on environmental and land use factors.

    (c)

    Pursuant to O.C.G.A. § 12-8-31.1, the board of commissioners has adopted, and may from time to time amend, the solid waste management plan for the county.

    (d)

    The construction and operation of municipal solid waste handling facilities which are inconsistent with the solid waste management plan for the county pose a threat to the health, safety and well-being of the public and can degrade the quality of the environment.

    (e)

    The board of commissioners, as the governing body of the county, has an obligation to ensure that proposed municipal solid waste handling facilities are consistent with the solid waste management plan for the county and that such facilities do not pose a threat to the health, safety and well-being of the public or degrade the quality of the environment.

    (f)

    The views of the public should be considered by the board of commissioners when evaluating whether a proposed municipal solid waste management facility is consistent with the solid waste management plan for the county or poses a threat to the health, safety and well-being of the public or may degrade the quality of the environment.
