§ 42-132. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Accidental occurrence means an accident, including continuous or repeated exposure, which results in bodily injury or property damage neither expected nor intended by the insured.

    Biomedical waste means pathological waste, biological waste cultures and stocks of infectious agents and associated biologicals, contaminated animal carcasses (body parts, their bedding and other wastes from such animals), sharps, chemotherapy waste, discarded medical equipment and parts, not including expendable supplies and materials which have not been decontaminated, as further defined in rule 391-3-4-.15 of the state board of natural resources, and other such waste materials.

    Commercial solid waste means all types of solid waste generated by stores, offices, restaurants, warehouses and other nonmanufacturing activities, including biomedical waste, but excluding residential and industrial solid wastes.

    Contaminant means any physical, chemical, biological or radiological substance or matter.

    Designated area means that geographic area which includes all individuals necessary to produce the sample size described in section 42-133(d).

    Industrial solid waste means solid waste generated by manufacturing or industrial processes or operations that is not a hazardous waste regulated under the Georgia Hazardous Waste Management Act, O.C.G.A. § 12-8-60 et seq. Such waste includes, but is not limited to, waste resulting from the following manufacturing processes: electric power generation; fertilizer and agricultural chemicals; food and related products and byproducts; inorganic chemicals; iron and steel products; leather and leather products; nonferrous metal and foundry products; organic chemicals; plastics and resins; pulp and paper; rubber and miscellaneous plastic products; stone, glass, clay and concrete products; textiles; transportation equipment; and water treatment. This term does not include mining waste or oil and gas waste.

    Municipal solid waste means any solid waste derived from households, including garbage, trash and sanitary waste in septic tanks and means solid waste from single-family and multifamily residences, hotels and motels, bunkhouses, campgrounds, picnic grounds and day use recreation areas. The term includes yard trimmings and commercial solid waste but does not include industrial solid waste or solid waste from mining, agricultural or silvicultural operations.

    Municipal solid waste handling facility means any facility the primary purpose of which is the storage, collection, transportation, treatment, utilization, processing or disposal, or any combination thereof, of municipal solid waste.

    Nonsudden accidental occurrence means an accidental occurrence which takes place over time and involves continuous or repeated exposure.

    P≤0.05 means the probability that a difference as great as the one proposed to be detected would occur by chance alone less than or equal to five percent of the time.

    Power, as used in section 42-133(d), means the probability of rejecting the hypothesis of no difference when that hypothesis is false or alternatively of accepting the hypothesis that there is a difference when in truth there is a difference.

    Release means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping or disposing into the environment.

    Solid waste means any garbage or refuse; sludge from a wastewater treatment plant, water supply treatment plant or air pollution control facility; commercial solid waste, including biomedical waste; industrial solid waste; municipal solid waste, including commercial solid waste; other discarded material, including solid, semisolid or contained gaseous material resulting from industrial, commercial, mining and agricultural operations and community activities, but not including recovered materials; solid or dissolved materials in domestic sewage; solid or dissolved materials in irrigation return flows or industrial discharges that are point sources subject to permit under 33 USC 1342; or source, special nuclear or byproduct material as defined by the Federal Atomic Energy Act of 1954, as amended (68 Stat. 923).

    Sudden accidental occurrence means an accidental occurrence which is not continuous or repeated in nature.
