§ 33-37. Junk or inoperable vehicles.

  • (a)

    This section shall be known and may be cited as the "Junk or Inoperable Motor Vehicle Ordinance."

    (b)

    For the purposes of this section, the following terms, phrases, words, and their derivations shall have the meanings given herein:

    Inoperable vehicle means a motor vehicle which cannot be operated lawfully on a public street or highway within the state for any reason other than the lack of current vehicle registration, or which cannot be moved under its own power.

    Motor vehicle means any vehicle which is self-propelled and designed to travel along the ground and shall include, but not be limited to, automobiles, buses, motorbikes, motorcycles, trucks, tractors, go-carts, golf carts, campers, and trailers.

    Owner means any person, firm, corporation, or other entity which is named as owning a vehicle and/or having any security interest therein according to any certificate of title for such vehicle issued by any department or agency of a state having authority to issue certificates; provided, that if no such certificate has been issued by a state or if none is available or can be obtained, the information indicating ownership as provided on the vehicle license registration shall be sufficient and, further provided, that if with reasonable diligence the information contained on the title certificate and the vehicle license registration cannot be obtained, the owner of a vehicle shall be considered unknown.

    Person means any person, firm, partnership, association, corporation, company, or organization of any kind.

    Private property means any real property within the county which is privately owned and which is not public property as defined in this section.
