§ 33-38. Offense; penalty.
(a)
It is declared to be an offense for any owner, agent, or tenant to maintain a nuisance. Each day a nuisance is continued shall constitute a separate offense. Following five days after receipt of certified written notice to the property owner, agent, or tenant, a citation may be issued by the county.
(b)
Penalties for the first violation of this section shall be a minimum fine of $100.00. The penalty for second violations of the same provisions of this section by the same owner or tenant shall be a minimum fine of $500.00. Third or repeat violations of the same provisions of this section by the same owner or tenant shall be a minimum fine of $1,000.00.
